Molimo vas da u potpunosti i pažljivo pročitate ove Opšte uslove pre korišćenja MyKidsPass-a i usluga koje nudi Family Pass, kako su bliže definisani ispod u članu 1. ovih Opštih uslova – Definicije. Ovi Opšti uslovi predstavljaju pravno obavezujuće odredbe i uslove za korišćenje MyKidsPass-a i usluga koje pruža Family Pass.

 

Please read these General Terms of Business fully and carefully before using MyKidsPass and the services offered by Family Pass, as defined under Article 1 of this GTB - Definitions. These GTB set forth the legally binding terms and conditions for your use of the MyKidsPass and the services provided by Family Pass.

Ovi Opšti uslovi važe za veb-sajt privrednog društva Family Pass, kako je ispod definisano, čiji je domen https://mykidspass.com/ i njemu pripadajuću mobilnu Aplikaciju koja je dostupna putem Apple store-a i Google Play prodavnice.

 

The following General Terms apply to the website of the company Family Pass, as defined below, whose domain is https://mykidspass.com/, and to the corresponding mobile application available on the Apple Store and Google Play Store.

Family Pass

Privredno društvo koje je osnovano i posluje u skladu sa propisima Republike Srbije, sa registrovanim sedištem na adresi Kondina 13, 11000 Beograd – Stari grad, Republika Srbija, registrovano u Registru privrednih subjekata koji vodi Agencija za privredne subjekte Republike Srbije, matični broj 21980340, PIB 114158961;

 

Family Pass

Legal entity which is duly incorporated and operates under laws of the Republic of Serbia, with its registered seat at the address Kondina 13, 11000 Belgrade – Stari grad, Republic of Serbia, registered in Companies Register maintained by Serbian Business Registers Agency, corporate ID no. 21980340, TIN 114158961;

MyKidsPass

Proizvod koji razvija Family Pass, a koji je dostupan Korisnicima i Partnerima putem Aplikacije;

 

MyKidsPass

A product developed by Family Pass, which is available to Users and Partners through the App;

Aplikacija

Mobilna aplikacija/ proizvod razvijen od strane Family Pass-a, kreirana od strane Family Pass-a, a koja omogućava Partnerima da oglašavaju svoje Podsticaje, a Korisnicima da se o takvim Podsticajima informišu i koriste ih; mobilna aplikacija putem koje su Korisnicima dostupni Edukativni video sadržaji;

 

Aplication

The mobile application/product developed by Family Pass, created by Family Pass, which allows Partners to advertise their Incentives and Users to access and use such Incentives; mobile application through which Educational video content is available to Users;

Partneri

Pravno lice ili preduzetnik koji ostvaruje saradnju sa Family Pass-om i u okviru koje omogućava Korisnicima korišćenje Podsticaja putem Aplikacije;

 

Partners

A legal entity or an entrepreneur who collaborates with Family Pass and within which enables Users to use Incentives through the Application;

Korisnik

Fizičko lice koje izvrši registraciju putem Aplikacije i plati mesečnu ili godišnju članarinu;

 

User

Individual who registers via the Application and pays a monthly or annual membership fee.

Podsticaji

Posebne pogodnosti koje u okviru svoje poslovne delatnosti kreira i oglašava Partner isključivo za Korisnike, a koje se sastoje, uključujući, ali ne ograničavajući se na popuste, akcije, sniženja, posebne pakete usluga i pogodnosti;

 

Incentives

Special benefits created and advertised within its business operations by the Partner exclusively for Users, which include, but are not limited to, discounts, promotions, reductions, special service packages, and advantages;

Usluge

Usluge informisanja Korisnika o Podsticajima Partnera u okviru MyKidsPass Aplikacije, i omogućavanje korišćenja Podsticaja putem QR koda koji se generiše putem Aplikacije.

 

Services

Services for informing Users about Partner Incentives within the MyKidsPass Application and enabling the use of Incentives through a QR code generated by the Application.

Edukativni vide sadržaj

video snimak edukativnog sadržaja iz oblasti domena stručnosti određenih edukatora u, a koji su dostupni Korisnicima putem Aplikacije;

 

Educational video content

video recording of educational content from the domain of expertise of certain educators in, which are available to Users through the Application;

2.                           Predmet i uvodne odredbe

 

2.                           Subject and Introductory Provisions

MyKidsPass je platforma putem koje Partneri oglašavaju svoje Podsticaje, kreirane posebno za MyKidsPass, i čine ih dostupnim na korišćenje registrovanim Korisnicima, kao i platforma koja registrovanim Korisnicima omogućava pristup različitim Edukativnim video sadržajima kreiranih od strane Partnera isključivo za MyKidsPass platformu.

 

MyKidsPass is a platform through which Partners advertise their Incentives, created specifically for MyKidsPass, and make them available to registered Users. The platform also provides registered Users with access to various Educational video content created by Partners exclusively for the MyKidsPass platform.

Uloga MyKidsPass-a je isključivo i samo u oglašavanju Podsticaja Partnera, i stoga, njegova isključiva odgovornost i obaveza je upravljanje Aplikacijom koja omogućava korišćenje Podsticaja. Family Pass ni na koji način ne snosi odgovornost za proizvode i/ili usluge koje Partneri nude i oglašavaju putem Aplikacije, kao ni za obavljanje ma koje obaveze ili usluge koja se oglasi putem Aplikacije od strane Partnera, a sve shodno odeljku 7. – Ograničenje odgovornosti.

 

The role of MyKidsPass is solely and exclusively to advertise Partner Incentives. Therefore, its sole responsibility and obligation is to manage the Application that enables the use of the Incentives. Family Pass is not in any way responsible for the products and/or services offered and advertised by Partners through the Application, nor for fulfilling any obligations or services advertised through the Application by Partners, all in accordance with section 7 – Limitation of Liability.

Upoznavanjem sa i prihvatanjem ovih Opštih uslova Korisnici su upoznati sa time da se putem MyKidsPass Aplikacije ne obavlja bilo kakva direktna transakcija ili kupovina sa Partnerima, već Aplikacija omogućava generisanje posebnog QR koda za svaki pojedinačni popust koji se potom može koristiti na prodajnim mestima i lokacijama Partnera.

 

By accepting these GTB, Users are aware that no direct transaction or purchase with Partners is carried out through the MyKidsPass Application, but rather the Application enables the generation of a separate QR code for each individual Incentive that can then be used at points of sale and Partner locations .

Partneri samostalno i po sopstvenom nahođenju kreiraju Podsticaje koje Korisnici mogu koristiti putem MyKidsPass Aplikacije i određuju dinamiku njihovog objavljivanja i dužinu njihovog trajanja. Partner je isključivo odgovoran da obavesti Korisnike o bilo kakvim ograničenjima u vezi sa Podsticajima (uključujući ali ne ograničavajući se na količine, trajanje i sl.).

 

Partners independently and at their own discretion create Incentives that Users can use through the MyKidsPass Application and determine the schedule for their publication and their duration. The Partner is solely responsible for informing Users of any limitations regarding the Incentives (including but not limited to quantities, duration, etc.).

Pristupanjem veb-sajtu i/ili Aplikaciji i dobrovoljnim kreiranjem korisničkog profila svi Korisnici prihvataju i izričito pristaju na ove Opšte uslove, kao i na Politiku privatnosti i Politiku kolačića ("Politike"), dostupne onlajn. Svaki Korisnik koji se ne slaže sa navedenim Opštim uslovima i/ili Politikama uzdržavaće se od korišćenja Aplikacije i Usluga. Svako dalje korišćenje navedene Aplikacije i Usluga, nakon upoznavanja sa ovim Opštim uslovima i Politikama, podrazumeva da je Korisnik saglasan sa njima i da pristaje na njihovo korišćenje. Registracijom - otvaranjem korisničkog naloga putem Aplikacije smatra se da je Korisnik ove Opšte uslove i Politike u celosti pročitao i prihvatio, te da je sa njima u celosti saglasan.

 

By accessing the website and/or the Application and voluntarily creating a user profile all Users accept and explicitly agree to these GTB, as well as the Privacy Policy and the Cookie Policy ("Policies"), available online. Any User who disagrees with the stated GTB and/or Policies will refrain from using the Application and Services. Any further use of the mentioned Application and Services, after becoming acquainted with these GTB and Policies, implies that the User agrees with them and consents to their use. By registering - creating a user account through the Application, it is considered that the User has read and accepted these GTB and Policies in their entirety and fully agrees with them.

3.                           Registracija i korisnički nalog

 

3.                           Registration and user profile

3.1                       Registracija

 

3.1                       Registration

Korisnik mora da otvori korisnički nalog prateći uputstva za registraciju kako bi mogao pristupiti MyKidsPass Aplikaciji. Inicijalna registracija na Aplikaciju je besplatna. Nakon registracije Korisnik će moći da vidi i da se upozna sa sadržajem koji je dostupan putem Aplikacije, ali neće biti u mogućnosti da koristi Podsticaje, niti će mu biti omogućen pregled Edukativnih video sadržaja. Kako bi mogao koristiti Podsticaje i Edukativne vide sadržaje potrebno je da se Korisnik pretplati na Aplikaciju, kako je bliže opisano u odeljku 4. ovih Opštih uslova.

 

A User must create a user profile following the registration instructions to access the MyKidsPass Application. Initial registration for the Application is free. After registration, the User will have access to the content available through the Application, but will not be able to use the Incentives, nor will be able to view Educational video content. To have access to the entire content of the Application and to use the Incentives and Educational video content, the User needs to subscribe to the Application, as further described in section 4 of these GTB.

Prilikom registracije, Korisnik mora da izabere korisničko ime i lozinku. Korisničko ime i lozinka su strogo poverljivi, lični i ne mogu se preneti na bilo koje treće lice. Korisnički podaci MyKidsPass Aplikaciju su privatni (osim ukoliko je drugačije dogovoreno pisanim putem između Family Pass-a i Korisnika). Korisnik je dužan da osigura da se svi podaci o korisničkom nalogu i slični podaci potrebni za pristup korisničkom nalogu Korisnika čuvaju u tajnosti i koriste na siguran način, koji nije dostupan trećim licima. Korisnik može imati samo jedan korisnički nalog. U cilju pojačanja bezbednosti naloga, Family Pass preporučuje da Korisnici ne koriste iste akreditive za prijavu kao na drugim platformama. U svakom slučaju, Family Pass ne garantuje bezbednost naloga ili profila.

 

During registration, the User must choose a username and password. Both the username and password are strictly confidential, personal, and cannot be transferred to any third party. User data in the MyKidsPass Application is private (unless otherwise agreed in writing between Family Pass and the User). The User is obligated to ensure that all account details and similar information required to access the User's account are kept confidential and used securely, not accessible to third parties. A User may have only one account. To enhance account security, Family Pass recommends that Users do not use the same login credentials as on other platforms. In any case, Family Pass does not guarantee the security of the account or profile.

Ukoliko postoji sumnja da je neko neovlašćeno lice saznalo za podatke o Korisnikovom korisničkom nalogu ili da ima pristup korisničkom nalogu Korisnika, Korisnik će o tome odmah obavestiti Family Pass. Korisnik je odgovoran za svako korišćenje MyKidsPass Usluge i bilo koju radnju pod korisničkim nalogom Korisnika.

 

If there is suspicion that an unauthorized person has learned the details of the User's account or has access to the User's account, the User will immediately notify Family Pass. The User is responsible for any use of the MyKidsPass Service and any actions under the User's account.

U cilju registracije na Aplikaciju, Korisnik mora da pruži određene podatke, kao što su: ime i prezime, korisničko ime, pol, imejl adresa, broj telefona i podaci o bankovnoj kartici, između ostalog. Kako je MyKidsPass platforma koja je prevashodno namenjena roditeljima i kako se u okviru MyKidsPass Aplikacije prevashodno oglašavaju Podsticaji Partnera i Edukativni vide sadržaji namenjeni roditeljima i deci, Family Pass prilikom registracije, a u cilju personalizacije sadržaja koji se čini dostupan Korisnicima može tražiti od Korisnika, a prilikom kreiranja korisničkog naloga i podatke o imenu ili nadimku deteta, polu deteta, godinama deteta i slično. Kada dovrši proces registracije, Korisnik može da pristupa svom profilu i da ga dopunjava i menja, po svom nahođenju.

 

To register for the Application, the User must provide certain information, such as name and surname, username, gender, email address, phone number, and bank card details, among other things. Since MyKidsPass is primarily intended for parents and the Incentives of Partners and Educational video content advertised within the MyKidsPass Application are mainly aimed at parents and children, Family Pass, during registration and to personalize the content made available to Users, may request from the User, when creating the account, additional information such as the child's name or nickname, gender, age, and similar details. Once the registration process is complete, the User can access their profile and update and change it at their discretion.

Korisnik garantuje da su sve informacije u vezi sa njegovim identitetom i mogućnostima koje je pružio Family Pass-u u obrascu za registraciju tačne, precizne i kompletne. Pored toga, Korisnici se obavezuju da svoje podatke redovno ažuriraju. Ako Korisnik pruži netačne, neprecizne ili nepotpune informacije ili ako Family Pass smatra da postoji osnovana sumnja u istinitost, preciznost ili integritet tih informacija, Family Pass Korisniku može uskratiti aktuelan ili budući pristup Aplikaciji ili njenom sadržaju i/ili uslugama, kao i njihovo korišćenje.

 

The User guarantees that all information regarding their identity and capabilities provided to Family Pass in the registration form is accurate, precise, and complete. Additionally, Users commit to regularly updating their information. If the User provides incorrect, inaccurate, or incomplete information, or if Family Pass believes there is reasonable doubt about the truthfulness, accuracy, or integrity of that information, Family Pass may deny the User current or future access to the Application or its content and/or services, as well as their use.

3.2                       Deaktivacija i otkazivanje naloga

 

3.2                       Deactivation and Cancellation of Accounts

Korisnik u svakom trenutku može deaktivirati svoj korisnički nalog prateći uputstva u okviru Aplikacije.

 

The User can deactivate their account at any time by following the instructions within the Application.

Family Pass zadržava pravo da suspenduje i/ili otkaže korisnički nalog Korisnika u slučaju da primeti da je Korisnik prestao da ispunjava sve osnovne uslove za registraciju, kao i u slučaju opravdane sumnje na lažnu ili nezakonitu upotrebu, uključujući korišćenje korisničkog naloga na način koji je u suprotnosti sa ovim Opštim uslovima.

 

Family Pass reserves the right to suspend and/or cancel the User's account if it notices that the User has ceased to meet all the basic registration requirements, as well as in the case of reasonable suspicion of fraudulent or illegal use, including the use of the account in a manner contrary to these GTB.

4.                           Pretplata i plaćanja

 

4.                           Subscription and Payments

Celokupan sadržaj Aplikacije (celokupan asortiman Podsticaja Partnera i svi edukativni video sadržaji) biće dostupni Korisniku tek nakon što se Korisnik pretplati na Aplikaciju, a po prethodno izvršenoj besplatnoj registraciji.

 

The entire content of the Application (including the full range of Partner Incentives and educational video content) will only be accessible to the User after subscribing to the Application, following the initial free registration.

Family Pass zadržava pravo da promeni iznos pretplate u bilo kom trenutku, uz obaveštavanje Korisnika kad i ako to nalažu važeći zakoni. Te promene stupaju na snagu odmah nakon objavljivanja. Iznos pretplate biće naplaćen sa platne kartice čije je podatke Korisnik uneo prilikom registracije.

 

Family Pass reserves the right to change the subscription fee at any time, with notification to the User as required by applicable laws and regulations. These changes take effect immediately upon publication. The subscription fee will be charged to the credit card that the User entered during registration.

Da bi se pretplatio na MyKidsPass Aplikaciju, Korisnik mora imati trenutno aktivni MyKidsPass korisnički nalog, mora biti punoletan i mora zatražiti da se pretplati na svom ličnom korisničkom MyKidsPass korisničkom profilu.

 

To subscribe to the MyKidsPass Application, the User must have a currently active MyKidsPass user account, must be of legal age, and must request the subscription through their personal MyKidsPass user profile.

Kako bi kompletirao postupak pretplate, Korisnik u okviru svog korisničkog naloga mora izabrati opciju "Pretplati se" i platiti u Aplikaciji navedeni mesečni ili godišnji iznos naknade.

 

To complete the subscription process, the User must within their user account select the "Subscribe" option and make the payment of the monthly or annual subscription fee as stated in the Application.

Datum uplate smatraće se datumom početka pretplate na MyKidsPass, a pretplata će važiti mesec ili godinu dana, u zavisnosti od izabranog perioda pretplate od tog datuma ("Datum aktivacije"). Na Datum aktivacije, Korisnik koji se pretplatio dobiće imejl sa potvrdom na imejl adresu koju je uneo prilikom kreiranja korisničkog naloga.

 

The date of payment will be considered the start date of the MyKidsPass subscription, and the subscription will be valid for either a month or a year, depending on the chosen subscription period from that date ("Activation Date"). On the Activation Date, the subscribed User will receive an email confirmation to the email address they provided during account creation.

Imajte na umu da Korisnik može uočiti određeno kašnjenje u efektivnoj aktivaciji svog pretplatničkog naloga od Datuma aktivacije; ako to kašnjenje premaši 48 časa, Korisnik treba da kontaktira FamilyPass korisničku podršku.

 

Please note that there may be a delay in the effective activation of the subscription from the Activation Date; if this delay exceeds 48 hours, the User should contact FamilyPass customer support.

Sve informacije koje se odnose na MyKidsPass pretplatu Korisnik može pronaći u Aplikaciji u odeljku „Moj nalog”. Tamo mogu proveriti preostalo vreme pretplate, kao i otkazati pretplatu ili ažurirati način plaćanja.

 

All information regarding the MyKidsPass subscription can be found in the Application under the "My Account" section. There, Users can check the remaining subscription time, as well as cancel the subscription or update the payment method.

4.1                       Trajanje pretplate

 

4.1                       Duration of Subscription

Period pretplate na MyKidsPass Aplikaciju traje mesec ili godinu dana do dana neposredno pre odgovarajućeg datuma narednog meseca/godine ("Period pretplate"), počevši od Datuma aktivacije i obnavlja se svakog meseca ili godine ako korisnik ne otkaže pretplatu. Stoga, ako je datum aktivacije 1. septembar, period pretplate će biti obnovljen 1. oktobra, ukoliko je pretplata mesečna ili 1. septembra iduće godine, ukoliko je pretplata godišnja.

 

The subscription period for the MyKidsPass Application lasts for a month or a year until the day immediately before the corresponding date of the following month/year ("Subscription Period"), starting from the Activation Date and renewing every month or year unless the user cancels the subscription. Therefore, if the activation date is September 1, the subscription period will be renewed on October 1 if the subscription is monthly or on September 1 of the following year if the subscription is annual.

Prihvatanjem ovih Opštih uslova, Korisnik potvrđuje i saglasan je da će se pretplata na MyKidsPass obnavljati automatski i da će se važeća naknada za pretplatu automatski naplaćivati sa računa koji Korisnik navede.

 

By accepting these GTB, the User acknowledges and agrees that the MyKidsPass subscription will be automatically renewed, and that the applicable subscription fee will be automatically charged to the account provided by the User.

4.2                       Otkazivanje pretplate

 

4.2                       Cancellation of Subscription

Ukoliko Korisnik ne želi da se pretplata automatski obnavlja, i želi da otkaže MyKidsPass pretplatu, može otkazati svoju pretplatu u bilo kom trenutku, kako je predviđeno ispod, a najkasnije do isteka Perioda pretplate ("Procedura odjave"). Ako Korisnik ne ispuni taj uslov u pogledu najave odjave pretplate, moraće da plati naknadu za pretplatu za sledeći mesec ili godinu.

 

If the User does not want the subscription to be automatically renewed and wishes to cancel the MyKidsPass subscription, they can cancel their subscription at any time as specified below, but no later than the end of the Subscription Period ("Cancellation Procedure"). If the User fails to meet this requirement regarding the notice of cancellation, they will have to pay the subscription fee for the next month or year.

Kako bi otkazao pretplatu, potrebno je da Korisnik pristupi svom korisničkom profilu i odabere opciju "Otkaži pretplatu". Korisnički nalog će biti deaktiviran na kraju važećeg Perioda pretplate.

 

To cancel the subscription, the User needs to access their user profile and select the "Cancel Subscription" option. The user account will be deactivated at the end of the current subscription period.

Ukoliko Korisnik ne ispoštuje Proceduru odjave, Family Pass nije u obavezi da vrati iznos koji je naplaćen od Korisnika po osnovu pretplate.

 

If the User fails to follow the Cancellation Procedure, Family Pass is not obligated to refund any subscription fees already charged.

Ukoliko, nakon Procedure odjave Korisnik želi da nastavi sa korišćenjem MyKidsPass Usluga, može se ponovo pretplatiti u skladu sa odredbama ovih Opštih uslova.

 

If, after following the Cancellation Procedure, the User wishes to continue using MyKidsPass services, they can resubscribe according to the terms outlined in these GTB.

U cilju izbegavanja svake sumnje, Korisnik u svakom trenutku može otkazati pretplatu, uzimajući u obzir da će u tom slučaju pretplata važiti do isteka Perioda pretplate i da nije moguće refundiranje iznosa pretplate kada se Korisnik već pretplatio. Otkazivanjem pretplate Korisnik obaveštava Family Pass da ne želi da nastavi sa pretplatom i da ne želi da mu se pretplata automatski obnavlja. Ukoliko Korisnik ne otkaže blagovremeno pretplatu, iznos pretplate koji bude bio naplaćen od Korisnka po osnovu pretplate neće biti moguće refundirati.

 

In order to avoid any doubts, the User can cancel the subscription at any time, taking into account that in this case the subscription will be valid until the end of the Subscription Period and that it is not possible to refund the amount of the subscription when the User has already subscribed. By canceling the subscription, the User informs Family Pass that he does not want to continue with the subscription and that he does not want his subscription to be automatically renewed. If the User does not cancel the subscription in time, the amount of the subscription that will be charged from the User based on the subscription will not be refunded.

4.3                       Iznos naknade za pretplatu

 

4.3                       Subscription Fee

Naknada za pretplatu na MyKidsPass usluge iznosi onoliko koliko je oglašeno u komercijalnoj ponudi ili u odeljku Aplikacije "Moj nalog" ili na web sajtu MyKidsPass-a. U iznos naknade za pretplatu su uračunati svi eventualni primenjivi porezi.

 

The subscription fee for MyKidsPass services is as advertised in the commercial offer or in the "My Account" section of the Application or on the MyKidsPass web site. The subscription fee includes all applicable taxes.

Family Pass zadržava pravo da promeni iznos naknade za pretplatu u bilo kom trenutku nakon slanja pisanog obaveštenja Korisnicima. Nakon ovakvog obaveštavanja Korisnika, Family Pass može otpočeti sa primenom novog iznosa naknade za pretplatu.

 

Family Pass reserves the right to change the subscription fee at any time after sending written notice to Users. Upon such notification, Family Pass may begin applying the new subscription fee amount.

Usluge plaćanja se ugovaraju od strane društva koje je osnovano i posluje u skladu sa propisima Republike Hrvatske My kids pass d.o.o.; OIB 49345931299; MB 05949971, a pruža ih platni servis kao treće lice ("MKP HR"). To takođe znači da je MKP HR odgovoran za potencijalne refundacije, reklamacije ili druge zahteve u vezi sa vašim transakcijama u okviru Aplikacije.

 

The payment services are provided by My kids pass d.o.o., a company established and operating in accordance with the laws of the Republic of Croatia, with the following details: OIB 49345931299, CID 05949971. These services are provided by a third-party payment service ("MKP CRO"). This also means that MKP CRO is responsible for any potential refunds, complaints, or other transaction-related issues within the Application.

5.                           Obaveze Korisnika

 

5.                           User Responsibilities

Korisnik je odgovoran za pravilno korišćenje sopstvenog korisničkog profila i sadržaja koji unese u Aplikaciju u skladu sa propisima Republike Srbije, načelima dobre vere, morala, opšteprihvaćenim običajima i društvenim poretkom. Takođe, obavezuje se na poštovanje ovih Opštih uslova.

 

The User is responsible for using their own user profile and any content they input into the Application in compliance with the regulations of the Republic of Serbia, principles of good faith, morality, generally accepted customs, and social order. They are also committed to complying with these GTB.

Korisnik ne sme koristiti Aplikaciju u nezakonite svrhe ili aktivnosti koje mogu povrediti prava drugih.

 

The User must not use the Application for unlawful purposes or activities that may infringe upon the rights of others.

Kršenje ovih obaveza može izazvati odgovornost Korisnika za štetu. Family Pass nije odgovoran za posledice nezakonitog korišćenja Aplikacije od strane trećih lica.

 

Violation of these obligations may result in the User's liability for damages. Family Pass is not responsible for the consequences of unlawful use of the Application by third parties.

Korisnik se obavezuje da ni na koji način neće kršiti prava intelektualne svojine, koristiti Aplikaciju za uvrede ili uznemiravanje, pristupati nalozima drugih Korisnika, uvoditi viruse, slati neželjene imejlove ili poruke, i generalno će se uzdržavati od bilo kakvih nepoželjnih aktivnosti.

 

The User agrees not to violate intellectual property rights in any way, use the Application for insults or harassment, access other Users' accounts, introduce viruses, send unsolicited emails or messages, and generally refrain from any undesirable activities.

6.                           Izjave i garancije u vezi sa radom Aplikacije

 

6.                           Representations and Warranties Regarding the Operation of the Application

Family Pass ne garantuje da neće biti grešaka ili prekida prilikom pristupa Aplikaciji ili njenom sadržaju, niti da će uvek biti u potpunosti ažurna. U skladu sa time, Family Pass neće odgovarati za prekide u pružanju usluge, za greške u povezivanju, za nedostupnost usluga pristupa internetu ili njihove kvarove, odnosno za prekide u dostupnosti interneta ili druge stvari van njegove kontrole. Bez obzira na gore navedeno, Family Pass će, osim u slučaju okolnosti koje to otežavaju ili onemogućavaju, preduzimati korake da otkloni te greške, da ponovo uspostavi komunikaciju i da ažurira sadržaj čim dođe do saznanja o postojanju grešaka ili o gubitku veze ili o zastarelosti sadržaja.

 

Family Pass does not guarantee that there will be no errors or interruptions when accessing the Application or its content, nor that it will always be fully up-to-date. Accordingly, Family Pass will not be liable for service interruptions, connection errors, unavailability of internet access services or their failures, or interruptions in internet availability or other matters beyond its control. Despite the above, Family Pass will, except in circumstances that hinder or prevent it, take steps to rectify these errors, restore communication, and update content as soon as it becomes aware of errors, loss of connection, or outdated content.

7.                           Ograničenje odgovornosti

 

7.                           Limitation of Liability

Family Pass nije odgovoran za sadržaj koji Partneri ili Korisnici otpreme putem Aplikacije; stoga, Partneri i Korisnici snose svu odgovornost za zakonitost takvog sadržaja. Family Pass ne kontroliše (i nije pod obavezom da kontroliše) kako Partneri i Korisnici koriste Aplikaciju. Family Pass ne garantuje da oni koriste Aplikaciju u skladu sa ovim Opštim uslovima ili na odgovoran i/ili razborit način i u skladu sa svim važećim zakonima i propisima. Uz to, Family Pass ne proverava (i nema obavezu da proverava) identitet korisnika ili istinitost, valjanost, potpunost i/ili autentičnost podataka koje mu Korisnici dostave.

 

Family Pass is not responsible for the content uploaded by Partners or Users via the Application; therefore, Partners and Users bear all responsibility for the legality of such content. Family Pass does not control (and is not obligated to control) how Partners and Users use the Application. Family Pass does not guarantee that they use the Application in accordance with these GTB or in a responsible and/or prudent manner, and in accordance with all applicable laws and regulations. Additionally, Family Pass does not verify (and has no obligation to verify) the identity of users or the accuracy, validity, completeness, and/or authenticity of the data provided to it by Users.

Family Pass je samo posrednik u oglašavanju i stoga ne snosi odgovornost koja proistekne iz informacija koje navedu Partneri ili Korisnici niti za gubitak ili štetu koju Korisnici ili Partneri mogu pretrpeti zbog kršenja ovih Opštih uslova. Kada se generiše QR kod putem Aplikacije za korišćenje Podsticaja, uspostavlja se direktna veza između Korisnika i Partnera. Family Pass nije strana u tom odnosu i samo pruža usluge Aplikacije da bi se omogućila posredna komunikacija između Partnera i Korisnika.

 

Family Pass acts solely as an intermediary in advertising and therefore does not bear responsibility arising from information provided by Partners or Users, nor for any loss or damage that Users or Partners may suffer due to a breach of these GTB. When a QR code is generated via the Application for the use of Incentives, a direct relationship is established between the User and the Partner. Family Pass is not a party to that relationship and merely provides Application services to facilitate indirect communication between Partners and Users.

Time što se registruju i pretplate na Aplikaciju, Korisnici prihvataju da su reklamacije koje žele da podnesu u smislu zakonske odgovornosti koja proistekne iz činjenja ili nečinjenja Partnera ograničene na Partnere, kao i da Family Pass ne mogu pozivati na odgovornost.

 

By registering and subscribing to the Application, Users accept that any complaints they wish to file regarding legal liability arising from the actions or inactions of Partners are limited to those Partners, and that Family Pass cannot be held liable.

Kao posrednik, Family Pass samo olakšava, putem Aplikacije, sredstva putem kojih uključene strane (tj. Korisnici i Partneri) mogu stupati u međusobni kontakt kako bi organizovale prodaju ili pružanje usluga. Stoga, Family Pass ni na koji način nije odgovoran i ne garantuje niti preuzima odgovornost za proizvode ili usluge koje nude Partneri ili za pružanje traženih usluga od strane Partnera. Family Pass neće proveravati proizvode i usluge koji se nude putem Aplikacije, i nije odgovoran za takvu proveru. Bez obzira na gore navedeno, Family Pass zahteva od svih Partnera da se pridržavaju svih važećih zakona i najviših standarda prilikom pripreme proizvoda i pružanja usluga, kao i prilikom pružanja informacija Korisnicima.

 

As an intermediary, Family Pass merely facilitates, through the Application, the means by which involved parties (i.e., Users and Partners) can contact each other to organize the sale or provision of services. Therefore, Family Pass is not in any way responsible and does not guarantee or assume liability for the products or services offered by Partners or the delivery of requested services by Partners. Family Pass does not verify the products and services offered through the Application and is not responsible for such verification. However, Family Pass requires all Partners to comply with all applicable laws and highest standards when preparing products, providing services, and providing information to Users.

Fotografije proizvoda/usluga prikazane u Aplikaciji pružaju se samo u ilustrativne svrhe, a konačni proizvod/usluga koju Korisnik kupuje od Partnera može se razlikovati od dostupnih fotografija.

 

The photographs of products/services displayed in the Application are provided for illustrative purposes only. The final product/service that the User purchases from the Partner may differ from the available photographs.

Korisnici i Partneri oslobađaju Family Pass od svake odgovornosti koja može proisteći iz dostupnosti proizvoda ili usluga.

 

Users and Partners release Family Pass from any liability that may arise from the availability of products or services.

Family Pass odbacuje svaku odgovornost za odštetu ma koje vrste koja može proizaći iz nezakonite upotrebe Aplikacije od strane Korisnika i/ili Partnera zato što su informacije koje se dostave netačne, trenutno nevažeće, nepotpune i/ili lažne. 

 

Family Pass denies any liability for damages of any kind that may arise from the unlawful use of the Application by Users and/or Partners due to inaccurate, currently invalid, incomplete, and/or false information provided.

8.                           Intelektualna svojina

 

8.                           Intellectual Property

Sva Prava intelektualne svojine u ili vezana za MyKidsPass kao i sva povezana dokumentacija i svi delovi i kopije istih će ostati isključivo poverene MyKidsPass-u i Partnerima te će biti jedino i isključivo vlasništvo MyKidsPass-a i/ili njegovih Partnera. „Prava intelektualne svojine“ označavaju autorsko pravo i srodna prava (uključujući baze podataka, pravo kataloga i fotografska prava), patente, korisničke modele, dizajnerska prava, žigove, naziv, poslovne tajne, know-how i bilo koji drugi oblik registrovanih ili neregistrovanih prava intelektualne svojine.

 

All Intellectual Property Rights in or related to MyKidsPass, including all associated documentation and all parts and copies thereof, shall remain exclusively vested in MyKidsPass and its Partners and shall be the sole and exclusive property of MyKidsPass and/or its Partners. 'Intellectual Property Rights' shall mean copyright and related rights (including databases, rights in compilations and photographic rights), patents, utility models, design rights, trademarks, trade names, trade secrets, know-how, and any other form of registered or unregistered intellectual property rights.

Ovi Uslovi poslovanja ne garantuju nikakva Prava intelektualne svojine Korisniku unutar MyKidsPass-a, te sva prava koja nisu izričito garantovana ovim Opštom uslovima su prava koja pripadaju MyKidsPass-u i Partnerima.

 

These GTB do not grant any Intellectual Property Rights to the User within MyKidsPass, and all rights not expressly granted herein are rights belonging to MyKidsPass and its Partners.

9.                           Trajanje i raskid

 

9.                           Duration and Termination

Ovi Uslovi poslovanja su na snazi kao obavezujući ugovor između Family Pass-a i Korisnika sve dok Korisnik koristi MyKidsPass Usluge.

 

These GTB remain in effect as a binding agreement between Family Pass and the User for as long as the User uses MyKidsPass Services.

Korisnik može prekinuti korišćenje MyKidsPass Usluge u bilo koje doba. Family Pass može prekinuti pružanje MyKidsPass Usluga privremeno ili trajno u bilo koje doba.

 

The User may discontinue the use of MyKidsPass Services at any time. Family Pass may cease providing MyKidsPass Services temporarily or permanently at any time.

10.                       Merodavno pravo i nadležnost

 

10.                       Applicable Law and Jurisdiction

Ovi Opšti uslovi su regulisani i tumače se u skladu sa pravom Republike Srbije.

 

TheseGTB are governed by and construed in accordance with the laws of the Republic of Serbia.

U slučaju nastanka bilo kakvog spora sa ili u vezi ovih Opštih uslova biće nadležan sud u Beogradu.

 

In case of any dispute arising from or related to these GTB, the competent court in Belgrade shall have jurisdiction.

11.                       Izmene

 

11.                       Amendments

Ovi Uslovi poslovanja su podložni izmenama. Family Pass će objavljivati izmenjene Opšte uslove na MyKidsPass internet stranici i obavestiće Korisnike da su Opšti uslovi izmenjeni putem Aplikacije ili putem elektronske pošte podnete Family Pass-u od strane Korisnika prilikom registracije. Ukoliko se Korisnik ne pristaje na izmene Opštih uslova, Korisnik će obustaviti korišćenje Aplikacije i Usluga.

 

These Terms of Service are subject to amendments. Family Pass will publish the amended Terms on the MyKidsPass website and notify Users that the Terms have been changed via the Application or through the email provided by the User during registration. If the User does not agree to the amended Terms, the User will discontinue using the Application and Services.

12.                       Ustupanje

 

12.                       Assignment

Family Pass je ovlašćen da ustupi sva ili neka prava ili obaveze koje proističu iz ovog odnosa u celosti ili delimično povezanom licu ili sukcesoru ili kupcu ili sticaocu njegove poslovne imovine bez prethodne saglasnosti Korisnika.

 

Family Pass is authorized to assign all or some rights or obligations arising from this relationship in whole or in part to a related entity, successor, purchaser, or acquirer of its business assets without prior consent from the User.

Korisnik nije ovlašćen da ustupi bilo koja prava ili obaveze koje proističu iz ovog odnosa u celosti ili delimično.

 

The User is not authorized to assign any rights or obligations arising from this relationship in whole or in part.

13.                       Završne odredbe

 

13.                       Final provisions

Ako se utvrdi da neka od klauzula ovih opštih uslova može biti ništava ili je ništava dejstvom zakona, može se smatrati da takva klauzula nije obuhvaćena. Takva izjava o ništavosti neće uzrokovati ništavost ostalih klauzula, koje ostaju važeće i na snazi između ugovornih strana.

 

If any clause of these GTB is determined to be void or voided by operation of law, it shall be deemed excluded. Such declaration of voidness shall not affect the validity of the remaining clauses, which remain valid and in force between the contracting parties.

Ovi Opšti uslovi sastavljeni su na srpskom i engleskom jeziku i u slučaju bilo kakve nesaglasnosti između ove dve verzije, preovlađujuća biće verzija na srpskom jeziku.

 

These general terms are drafted in Serbian and English, and in case of any discrepancy between these two versions, the Serbian version shall prevail.

Ovi Opšti uslovi stupaju na snagu dana 11.09.2024. godine.

 

These GTB come into effect on the 11 September 2024.
